I’m really excited that you are booking a family photo session with me. I really do love capturing families doing their natural thing, it is so very important to have those memories captured. All you need to do now is read through the T’s + C’s, fill out the form below and pay the booking fee (50% of total session fee) or insert your voucher code. Once I have received both your booking is complete! I will confirm the receipt and the date & time we have arranged in an email to you along with the invoice for the booking fee. Terms & Conditions

The (regrettably rather formal) purpose of the below T's & C's is to set out the professional basis on which we'll work together and clarify our respective responsibilities. Yours, to enjoy yourself and just be you, easy peasy. Mine? To document you and your people in the most wonderful way.

Please take a moment to read through the below before confirming your booking.

1. Your Photography Session

Your session includes a relaxed, natural approach to photography, with gentle guidance where needed, and a carefully selected collection of professionally edited, high-resolution images delivered via a private online gallery.

The duration, number of images and inclusions of each session option are outlined on my family photography page. Your chosen session will be confirmed at the time of booking.

All delivered images include personal printing and sharing rights.

For families of six or more people, an additional fee may apply. Any additional costs will always be discussed and agreed before booking.

2. Booking & Payment

Your session date and chosen package have already been agreed. Your booking is secured once the completed booking form and booking fee have been received.

The booking fee is 50% of your session cost and is deducted from the total price. In the event of cancellation, any amount retained will reflect reasonable costs or losses incurred, subject to applicable consumer rights.

The remaining balance is due following your session and must be paid in full before your completed gallery is delivered.

If a valid gift voucher is being used, its value can be applied towards the session fee, subject to the voucher's terms, availability and expiry date, and any applicable consumer rights.

3. Location & Travel

Sessions take place in and around the West Midlands unless otherwise agreed in advance. Travel outside this area may incur an additional fee, which will always be discussed before booking.

For babies under one year old, an at-home session is generally recommended, although other suitable locations can be discussed.

If a location requires special permission, admission fees or photography permits, these must be arranged and agreed before the session.

4. Rescheduling & Cancellation

If you need to rearrange your session, please let me know as soon as possible.

I completely understand that illness and unexpected emergencies happen, particularly with little ones, and I'll always do my best to accommodate a new date, subject to availability. Even if it's on the day, I'd much rather rearrange than have you turn up feeling poorly!

Sessions can be rescheduled up to twice without an additional booking fee, provided I haven't already incurred costs, such as travel or arriving at the agreed location. If a session needs to be rearranged more than twice, a new booking fee may be required to secure another date.

If you need to cancel your session entirely, please let me know in writing. Any cancellation charges or refunds will reflect reasonable costs or losses incurred, in accordance with applicable consumer rights.

If I'm unable to attend due to illness, emergency or circumstances beyond my control, I'll offer an alternative date. If a suitable date cannot be agreed, any payments for services not provided will be refunded.

Nothing in this section affects your statutory cancellation rights.

5. Weather

Outdoor sessions are weather dependent. A little drizzle doesn't necessarily mean we need to cancel, and where possible we can adapt our plans, change locations or switch to an at-home session.

However, in the case of extreme weather, including heavy rain, storms or unsafe conditions, I may decide that postponing is the best option.

Weather-related postponements will be rearranged to a mutually agreed date without an additional rescheduling fee.

6. Session Timings & Cooperation

Please arrive on time and ready for your session. If you're running late, let me know as soon as possible. Unfortunately, I can't always extend sessions beyond the agreed finishing time, particularly where I have other commitments.

My approach to family photography is relaxed, natural and child-led. I want everyone to feel comfortable and enjoy themselves, rather than feeling pressured into performing for the camera.

That said, the success of a session does rely on a reasonable level of cooperation from those being photographed.

I completely understand that babies and children can be unpredictable, and I'll always do my best to work around their moods, energy levels and needs. However, I cannot guarantee particular smiles, expressions, poses or photographs if someone is unwilling or unable to participate.

If a child becomes upset, needs a break or simply doesn't want to be photographed, I'll adapt wherever possible. I won't force a child to participate or continue photographing them against their wishes.

Where photographs cannot be captured due to a lack of cooperation, this does not automatically entitle the client to a reshoot, additional images or a refund, provided the agreed service has been delivered with reasonable care and skill.

Parents and guardians remain responsible for supervising their children throughout the session. I reserve the right to stop or decline any activity that I consider unsafe.

7. Artistic Licence & Creative Approach

The Client acknowledges that they are familiar with the Photographer's portfolio and distinctive photographic style, and that the Photographer will use their professional judgement and artistic discretion throughout the session and editing process.

The Photographer shall be granted full artistic licence in relation to composition, lighting, locations, moments captured, image selection and post-production. The Photographer's judgement regarding the final selection and editing of images shall be deemed correct, provided the work is carried out with reasonable care and skill and is consistent with the Photographer's established style.

While every reasonable effort will be made to capture requested photographs and family combinations, no specific image, pose, expression or moment can be guaranteed.

The Photographer retains final discretion over which images are selected, edited and delivered, in keeping with their established photographic style.

8. Image Selection, Editing & Delivery

Your completed gallery will normally be delivered within four weeks of your session, unless otherwise agreed. If unexpected circumstances affect this timeframe, I'll keep you informed.

All images are carefully selected and professionally edited to a high and consistent standard, in keeping with my established photographic style.

The final selection of photographs is made at my discretion. Test shots, duplicates, missed-focus images, unflattering expressions and photographs that do not meet my professional standards will not be included.

Not every photograph taken during the session will be delivered. RAW files, unedited photographs and rejected images are not provided.

Additional retouching or editing requests outside my usual style are not included in the session fee and may be declined or quoted separately.

9. Image Usage, Copyright & Artificial Intelligence

All photographs remain the copyright of Kate Jackson Photography.

Clients are granted permission to download, print and share their delivered photographs for personal, non-commercial use only.

Photographs may not be sold, licensed, supplied to businesses or used for commercial, advertising or promotional purposes without prior written permission.

You're very welcome to share your photographs with friends, family and on social media. I just ask that they aren't edited, filtered, recoloured or otherwise altered after delivery, so they remain true to my work.

The use of artificial intelligence (AI) to edit, enhance, manipulate, recreate or generate new versions of any photographs is strictly prohibited. This includes adding or removing people or objects, altering faces, changing backgrounds or generating alternative versions of the original images.

Photographs must not be uploaded, submitted or otherwise supplied to AI systems for the purposes of image manipulation, generative AI, model training, machine learning or creating derivative images, under any circumstances. No permission will be granted for these uses.

Ordinary storage, backup, viewing and sharing of the original, unaltered photographs are permitted.

10. Image Sharing & Privacy Preferences

I love sharing photographs from the lovely families I work with, but I completely understand that not everyone wants their images shared publicly, particularly when children are involved.

Your preferences are recorded separately within this booking form, and I will only use your photographs for portfolio, website, social media or marketing purposes in accordance with the option you've selected.

Where permission is given to share images without identifiable faces, or without identifiable children's faces, I will respect those restrictions when selecting photographs for public use.

Where complete privacy has been requested, no photographs from your session will be shared publicly or used for portfolio or marketing purposes.

You can contact me at any time to withdraw permission for future use of your photographs. Where images have already been published on platforms I control, I will take reasonable steps to remove them following your request. However, I cannot guarantee the removal of copies already shared or saved by third parties.

Your image-sharing preference will not affect the quality of your session, the photographs delivered or the service you receive.

11. Equipment Failure & Unforeseen Circumstances

The Photographer will always carry appropriate backup equipment where reasonably practical and take reasonable precautions to protect photographic images.

In the unlikely event of the total loss of photographic images due to technical failure, file corruption, theft, accidental damage or other circumstances beyond the Photographer's control, the Photographer's liability shall be limited to the return of any monies paid by the Client for the session, to the extent permitted by law.

Nothing in this clause excludes or restricts liability that cannot legally be excluded or affects the Client's statutory consumer rights.12. Gallery Access & File Storage

Your completed photographs will be delivered via a private online gallery, where you can download and share your images.

Your online gallery is not intended as permanent file storage, so please download your photographs promptly and save copies in more than one place.

I aim to retain backup copies of delivered photographs for a minimum of one year following your session. While every reasonable effort is made to keep these files safe, I cannot guarantee their permanent storage or recovery.

Once your photographs have been delivered, you are responsible for keeping your downloaded copies safe.

13. Complaints & Concerns

I genuinely want you to love both your photographs and the experience of having them taken, so if anything doesn't feel right, please get in touch.

Any concerns should ideally be raised in writing within 14 days of gallery delivery, or as soon as reasonably possible after an issue becomes apparent.

I will acknowledge your message and aim to respond within 14 days.

If a concern relates to a failure to provide the agreed service with reasonable care and skill, an appropriate remedy will be considered in accordance with applicable consumer law.

Nothing in these terms affects your statutory rights, including your right to raise a valid complaint after the suggested 14-day period.

14. Privacy & Personal Data

Kate Jackson Photography collects and processes personal information necessary to manage bookings, communicate with clients, deliver photographs and meet legal and business obligations.

All personal data will be handled in accordance with applicable UK data protection legislation, including the UK GDPR and Data Protection Act 2018.

Personal information will only be retained for as long as necessary for the purposes for which it was collected, including applicable legal, tax and record-keeping requirements.

Photographs will be handled in accordance with your selected image-sharing preferences and my Privacy Policy.

Please ensure you've read Kate Jackson Photography's Privacy Policy.

15. General Terms

These terms, together with your chosen session details, booking confirmation and any written amendments, form the agreement between the client and Kate Jackson Photography.

Any changes to the agreed session, location, services or additional fees must be confirmed in writing.

These terms are governed by the laws of England and Wales, subject to any mandatory consumer protections that apply.

Nothing in this agreement affects your statutory consumer rights.

Once I've received your booking form and booking fee, I'll confirm your session date and time along with all the details you need.
